During the acquisition of real estate, the buyer needs to come to Turkey several times to draw up documents. In order not to waste time traveling, you can draw up a power of attorney and transfer the right to sign documents and represent your interests in government bodies to a trustee. This may be a realtor or a person from your close circle, whom you fully trust. He will be able to get TAPU instead of you, confirming the ownership of the real estate.
The power of attorney is issued at a Turkish notary public. This is a fairly quick procedure, which takes no longer than 1-2 hours. Time depends on the workload of notary specialists.
To issue a power of attorney, you must have:
2 passport format photos (in Turkey, a proxy photo must be on the power of attorney);
certified translation of the principal's passport (it can be done at the same notary office before issuing the power of attorney).
If the principal does not speak Turkish, translation services will be required. As a rule, it is in most notary offices.
After the notary receives the documents, he will prepare a standard power of attorney, which indicates:
notary data;
principal information;
proxy information;
functions that the principal can perform;
photocopy of the passport of the principal on the reverse side of the power of attorney.
By issuing a power of attorney, you do not risk anything, since the presence of a power of attorney does not give another person the right to this property, because only your surname and photo will be indicated in TAPU. It should also be borne in mind that in Turkey the power of attorney is issued for an unlimited period, therefore, after the transaction is completed, it is advisable to revoke the power of attorney.
In addition to acquiring real estate, a power of attorney in Turkey can be issued for:
rent and sale of real estate in Turkey;
property management in Turkey;
banking operations on your behalf;
investing and using money on your behalf;
filing claims and participating in litigation;
tax transactions, etc.
The cost of issuing a Turkish power of attorney is on average 220-250 Turkish liras. The prices for certification of a passport are about 60 lire. Translation services will cost an average of 100-150 lire. If you need to make several copies of the power of attorney, each will have to pay about 90-100 lire.
